    Housing Discrimination - Fair Housing

    The Fair Housing Act safeguards people from discrimination when they are renting or purchasing a home, getting a mortgage, looking for housing assistance, or participating in other housing-related activities.

    The Fair Housing Act forbids discrimination in housing due to the fact that of:

    - Race.
    - Color.
    - National Origin.
    - Religion.
    - Sex.
    - Familial Status.
    - Disability.
    What Is Prohibited?

    In the Sale and Rental of Housing:

    It is unlawful discrimination to take any of the following actions due to the fact that of race, color, religion, sex, impairment, familial status, or national origin:

    - Refuse to rent or sell housing.
    - Refuse to negotiate for housing.
    - Otherwise make housing not available.
    - Set various terms, conditions or benefits for sale or rental of a dwelling.
    - Provide an individual different housing services or centers.
    - Falsely deny that housing is readily available for examination, sale or rental.
    - Make, print or release any notice, declaration or ad with regard to the sale or leasing of a home that suggests any preference, restriction or discrimination.
    - Impose various sales rates or rental charges for the sale or rental of a residence.
    - Use different qualification criteria or applications, or sale or rental requirements or treatments, such as income requirements, application requirements, application charges, credit analyses, sale or rental approval procedures or other requirements.
    - Evict a tenant or an occupant's visitor.
    - Harass an individual.
    - Fail or delay efficiency of maintenance or repairs.
    - Limit advantages, services or centers of a dwelling.
    - Discourage the purchase or leasing of a residence.
    - Assign an individual to a specific structure or area or area of a structure or area.
    - For earnings, persuade, or try to persuade, house owners to offer their homes by suggesting that people of a specific secured attribute will move into the area (blockbusting).
    - Refuse to supply or discriminate in the terms or conditions of property owners insurance coverage due to the fact that of the race, color, faith, sex, disability, familial status, or national origin of the owner and/or occupants of a dwelling.

    In Mortgage Lending:

    It is unlawful discrimination to take any of the following actions based upon race, color, religion, sex, special needs, familial status, or national origin:

    - Refuse to make a mortgage loan or supply other financial help for a home.
    - Refuse to provide information regarding loans.
    - Impose various terms or conditions on a loan, such as different interest rates, points, or costs.
    - Discriminate in appraising a dwelling.
    - Condition the availability of a loan on a person's reaction to harassment.
    - Refuse to buy a loan.
    Harassment:

    The Fair Housing Act makes it unlawful to harass individuals due to the fact that of race, color, faith, sex, special needs, familial status, or national origin. Among other things, this forbids unwanted sexual advances.

    Retaliation and Other Prohibitions:

    It is unlawful discrimination to:

    - Threaten, coerce, frighten or disrupt anybody exercising a reasonable housing right or helping others who exercise the right.
    - Retaliate against a person who has actually filed a fair housing complaint or assisted in a fair housing investigation.
    Reasonable Accommodations and Reasonable Modifications

    Under the Fair Housing Acts a reasonable accommodation is a change, exception, or change to a guideline, policy, practice, or service. The Fair Housing Act makes it illegal to refuse to clear up lodgings to rules, policies, practices, or services when such accommodations might be necessary to pay for individuals with disabilities an equal chance to use and delight in a home and public and common use locations.

    In addition, the Fair Housing Act prohibits a housing supplier from refusing to allow, at the expense of the individual with a disability, reasonable adjustments of existing facilities occupied or to be occupied by such individual if such modifications may be necessary to pay for such person complete pleasure of the facilities.

    What is Needed for a Problem

    To submit a housing discrimination complaint these requirements must be met:

    - The residential or commercial property needs to be within the state of Texas.
    - The residential or commercial property owner, in many cases, should have more than 3 residential or commercial properties. This does not consist of multi-family houses.
